Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Leap creator workspace and related services ("Service"), operated by Leap and available at useleap.xyz.

By creating an account, purchasing credits, or using the Service in any way, you agree to these Terms. If you are using the Service on behalf of a company or other organization, you represent that you have authority to bind that organization, and "you" refers to that organization.

• You are at least 13 years old (or 16 in the European Economic Area).
• You are not prohibited from using the Service by law.
• You will provide accurate information when creating an account and keep that information up to date.

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. If you learn of or suspect unauthorized use, contact us promptly at support@useleap.xyz.

• Credits are purchased in packs and are consumed when you generate content such as scripts, voice, images, or videos.
• Purchased credits do not expire due to time alone and are not transferable or redeemable for cash.
• Payments are processed through our payment provider (Stripe). You agree to pay all charges associated with your account and to provide accurate payment details.
• Except as required by law, credit purchases are final and non-refundable. If you believe you were charged in error, contact us within 30 days and we will review your request.
• Credits are valid only within the Service and have no monetary value outside it. We may adjust how much each generation costs as the Service evolves, and we will give reasonable notice of material changes.

You retain ownership of the content you create and upload through the Service. You grant Leap a non-exclusive, worldwide, royalty-free license to host, store, process, and display your content solely to provide the Service to you.

You represent that you have all rights needed to use your content and that it does not infringe the rights of any third party or violate applicable law.

• Content generated by AI may be inaccurate, incomplete, or unsuitable for your publication. You are responsible for reviewing and verifying generated content before publishing or relying on it.
• Do not use generated content for decisions that could affect the safety, health, or legal rights of any person.
• You are solely responsible for how you use generated content, including compliance with the policies of platforms where you publish.
• Generated content may read or sound similar to other material. We do not guarantee that generated content is original or free of third-party claims.

You agree not to use the Service to:

• Create, publish, or share illegal, harmful, or infringing content.
• Create sexual or exploitative content involving minors. This is strictly prohibited and will be reported to appropriate authorities.
• Harass, threaten, impersonate, or defame any person.
• Use the Service to deceive others, including through spam, phishing, or misleading AI-generated media.
• Reverse engineer, scrape, or attempt to interfere with the Service, its infrastructure, or its security.
• Resell, sublicense, or provide the Service to third parties without our consent.
• Violate the terms of any third-party platform, such as YouTube, or any applicable law.

We may review activity and content for compliance with these Terms, but we are not obligated to monitor the Service.

The Service itself — including its software, design, branding, and documentation — is the property of Leap and its licensors and is protected by intellectual property laws. We do not grant you any rights in the Service other than the limited right to use it in accordance with these Terms.

The Service integrates with third-party services, including AI providers, payment processing, Google sign-in, and YouTube. Your use of those services is subject to their own terms and privacy policies, and we are not responsible for their actions or content.

We may suspend or terminate your access to the Service at any time if you violate these Terms or the law, or where we believe doing so is necessary to protect the Service or other users.

You may stop using the Service and delete your account at any time. Sections of these Terms that by their nature should survive termination — including content ownership, disclaimers, limitation of liability, and indemnification — will continue to apply.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will meet your expectations.

To the maximum extent permitted by law, Leap and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of these Terms will not exceed the amount you paid us in the 12 months before the claim, or $100 if you have not paid us anything.

You agree to indemnify and hold harmless Leap and its affiliates, officers, employees, and agents from any claims, damages, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

We may change, add, or remove features of the Service, and we may update these Terms from time to time. We will update the "Last updated" date above and notify you of material changes where appropriate. Your continued use of the Service after changes take effect means you accept the updated Terms.

These Terms are governed by the laws of your local jurisdiction, without regard to its conflict-of-law principles. You agree to attempt to resolve any dispute informally with us first. Where a court has jurisdiction over a dispute, you consent to its exclusive jurisdiction, to the extent permitted by law.
